Terms of Service

Rules for using LaborWork services, application and website.

1Acceptance of these Terms and Conditions of Service

These Terms and Conditions of Service (hereinafter referred to as the "Terms") apply when you use the application, website, offices, contact channels or any service of Foreign Worker Employment Agency Laborwork Company Limited (hereinafter referred to as "LABORWORK", "we" or "the Company").

When you create an account, submit a service request, make a payment, or select "Acknowledge and Continue", you are deemed to have acknowledged these Terms, the details of the relevant service, the Refund and Service Policy, and the Privacy Policy. If you are acting on behalf of an employer, an employee, a family member or any other person, you confirm that you hold the appropriate authority or permission to do so.

When you submit copies of passport and visa pages to the Company (whether in digital file format or as paper documents), or any other documents relating to migrant worker documentation — including applications for a work visa or work permit, work visa extensions, the issuance of a passport or travel document, and other related documents; and, in the case of employers, documents such as the national ID card, house registration, company affidavit, power of attorney or other related documents — you must ensure that such documents are genuine and correct and that consent has been obtained from the owner of those documents. If it subsequently comes to the Company's knowledge that the documents you provided were incorrect, false, forged, or that their provision constituted any unlawful act, you shall be solely liable for any damage caused to the Company, and this shall in no way be deemed the fault of the Company.

The Company hereby notifies you that these Terms and Conditions are the copyright and intellectual property of the Company alone. No person may use them to obtain or seek any unlawful benefit in any manner whatsoever without the Company's express permission. If the Company becomes aware that you or any other person, whether as principal or agent, and whether directly or indirectly, has infringed the rights in these Terms and Conditions or any intellectual property rights of the Company, you or such person shall be liable to the Company for the full value of the damage caused, and the Company reserves the right to pursue civil and criminal proceedings until final judgment.

2Scope of services and LABORWORK's role

2.1 LABORWORK provides services relating to the recruitment of migrant workers, immigration, work permits, visas, passports, certificates of identity, employer matters, embassy matters, and related official documentation. The scope, price, required documents, payment instalments and procedures for each service are set out on the relevant service page, quotation, service order or confirmation letter, and shall form part of these Terms.

2.2 LABORWORK is not a government agency and has no authority to grant approvals. We may verify your information before accepting a case, and may request additional information, refuse and/or suspend a service if you submit incomplete documents, submit false documents, render the service unlawful or impossible for the Company to perform, if eligibility is unclear, or if any action would give rise to unreasonable legal or operational risk.

3User accounts and the Company's authority to access information

3.1 You must provide information and documents that are complete, accurate, current and genuine.

3.2 You must keep your account, passwords and verification codes secure, and notify LABORWORK promptly if you become aware of any unauthorised use.

3.3 Employers, agents or authorised representatives submitting information on behalf of another person must hold proper and appropriate authority, and must inform that person about the relevant service and the applicable Privacy Policy.

3.4 You must notify LABORWORK promptly of any change to a passport, visa, employment status, employer, contact details or other information that affects the service.

LABORWORK may rely on the information and documents it receives, unless there is reasonable cause for doubt. You shall be responsible for any consequences arising from information that is false, altered, incomplete, expired or materially misleading.

4Customer obligations and deadlines

Official procedures may be subject to strict deadlines. The customer must submit documents, pay each instalment, attend medical examinations, provide biometric data, attend the Immigration Bureau or other appointments, and take any requested action immediately within the time notified by LABORWORK or by the relevant authority.

If a case expires, becomes invalid, is rejected, or cannot proceed because of late payment, failure to submit documents, missed appointments, failure to follow reasonable instructions, or any delay caused by the customer, LABORWORK shall not be responsible for the approval outcome or for any additional costs incurred. Amounts relating to work the Company has already performed, and official fees or third-party costs already incurred, shall be dealt with in accordance with the Company's Refund and Service Policy.

5Service fees and payment

5.1 LABORWORK will inform the customer of the price and payment instalments before the customer confirms acceptance of the service.

5.2 LABORWORK's service fees are separate from official fees, embassy fees, medical examination fees, insurance, translation, delivery or other third-party costs, unless expressly stated to be included.

5.3 The customer must pay by the due date. If the customer fails to pay after LABORWORK has duly given notice, the Company may temporarily suspend performance of the service until payment is received as notified.

5.4 If an authority or third party imposes a fine or any other fee, or if the customer requests additional work, LABORWORK will notify the customer as promptly as reasonably practicable, and further confirmation and payment may be required before the Company continues work.

5.5 For the customer's benefit and convenience, LABORWORK recommends that you retain receipts or proof of payment for reference.

6Authority decisions, processing times and policy changes

Approvals, processing times, appointment queues and additional requirements are subject to the discretion of government agencies, state bodies, embassies, consulates or relevant third parties. LABORWORK will exercise professional standards of care, but the Company does not guarantee approval or completion by any specified date.

Authorities may issue, amend, suspend, postpone or cancel policies, programmes, deadlines, eligibility criteria, fees, procedures or electronic systems, and this lies outside LABORWORK's control. The Company may adjust procedures, request further documents, charge additional costs, place a case on hold, or cancel affected services.

Where LABORWORK has received an initial service fee before a government programme has officially opened, but the programme subsequently does not open or is not authorised, the refund of that initial service fee shall be governed by the Company's Refund Policy and Service Terms and Conditions.

7Cancellation and refunds

Rights to cancellation and refund depend on the stage reached, the work LABORWORK has already performed, official submissions already made, and official fees or third-party costs already paid or committed. The Refund and Service Policy forms part of these Terms and applies to every refund request. Submitting a service request or making a payment is not a guarantee of approval by any government agency. Service fees are consideration for the professional work performed by LABORWORK.

8Electronic communications, records and privacy

LABORWORK may make contact through the application, website, email, telephone, SMS, LINE or other contact details provided by the customer. The customer must monitor those channels and keep their contact details up to date, particularly where a case is subject to official deadlines.

Electronic selections, instructions, confirmations, timestamps, messages and payment records may be used as evidence of a request, an acknowledgement or a transaction. Personal data will be handled in accordance with LABORWORK's Privacy Policy.

9Acceptable use and intellectual property

You must not use LABORWORK's application or services to submit false documents, impersonate another person, access another person's account, interfere with systems, distribute malicious software, breach the law, or misuse official processes.

LABORWORK's names, marks, logos, application, website, software, text, designs, workflows and other materials are the property of LABORWORK or its licensors. You may use them solely for the purpose of receiving LABORWORK's services, and you must not copy, modify, distribute, reverse-engineer or commercially exploit them without written permission.

10Suspension or termination of service

LABORWORK may suspend or terminate a customer's account or services if the customer breaches these Terms, fails to pay, provides suspicious or false documents or commits any unlawful act, misuses the application, harasses staff or other users, creates a security risk, or where suspension is required by law or by an authority.

Suspension or termination does not extinguish the obligation to pay for work already performed or costs already incurred. Refunds or unused balances will be assessed in accordance with the Refund and Service Policy.

11Force majeure and liability

LABORWORK is not responsible for delay or non-performance arising from events beyond its reasonable control, such as natural disasters, epidemics, war, civil unrest, strikes, the closure of borders or government offices, failure of government systems, widespread power or communications failure, cyber attack, or other events of a similar nature. LABORWORK will use reasonable efforts to mitigate the impact and to resume work as soon as it is able.

LABORWORK is responsible for performing the agreed services with professional standards of care. To the extent permitted by law, LABORWORK shall not be liable for indirect or consequential damage, for the decisions of authorities or third parties, or for damage arising from the customer's acts or omissions. Nothing in these Terms excludes any liability or customer right that may not be excluded by law.

12Amendments, complaints, governing law and language

LABORWORK may amend these Terms when services, application functions, authority requirements or the law change. Material changes will be notified through appropriate channels and will generally apply to future events. Confirmed service orders will generally be governed by the version acknowledged by the customer on the order date, unless an amendment is required by law or by order of an authority, or is to the customer's benefit.

If you have a complaint, please contact LABORWORK first so that we may investigate and attempt to resolve it. These Terms are governed by Thai law and do not limit consumer rights or the right to contact any competent authority or court.

The English, Thai and Burmese versions are intended to have the same meaning. In the event of any inconsistency, the Thai version shall prevail to the extent permitted by law.
